Social Media Contests by Medicom
The "Medicom Social Media Contest" is an action by Medicom Pharma GmbH (hereinafter referred to as Medicom), based in Sedemünder 2, 31832 Springe. Participation in this contest is exclusively subject to these terms and conditions and does not require the purchase of any goods or services. This action is in no way associated with Instagram or Facebook and is not sponsored, supported, or organized by Instagram or Facebook.
Participation Requirements
A prerequisite for participation in the contest is to follow the Instagram accounts @medicomde and @duschkind, as well as to like and comment on the contest post published on July 11, 2024, on Instagram by @medicomde. The deadline for participation is July 20, 2024, 11:59 PM.
Eligibility
Eligible participants are individuals over 18 years of age who reside in Germany. Persons under 18 years of age require the consent of their legal guardian(s) to participate. If this consent is not provided, participation in the contest is excluded. Employees of Medicom, their relatives, and all persons involved in the contest, especially those involved in the technical and/or organizational implementation or execution, are also excluded from participating in the contest.
Prize, Notification, and Prize Delivery
Among all entries, 1 set from Medicom and Duschkind will be raffled off. After the end of the contest, the winners will be notified within 5 days via private message on Instagram and asked to send an email or reply to the private message to Medicom to confirm the win and provide their address details (name, address). In the event that a prize confirmation is not received within 7 days, the prize will be forfeited. After providing the address details, the prize will be sent by mail at Medicom's expense. A cash payout of the prize is excluded.
Data Protection
In the event of a win, the participant agrees that their submitted data (name, address, and Instagram username) may be collected, processed, and used by Medicom Pharma GmbH, Sedemünder 2, 31832 Springe, and by Duschkind GmbH, Emsstraße 3,
49134 Wallenhorst, for the purpose of carrying out and managing the contest. For minors, the aforementioned consent must be given by the legal guardian(s). The participant can object to the use of their data at any time in writing or by email to Medicom at info@medicom.de. This will result in the personal data no longer being processed and used. They will then be excluded from the contest. After the contest has been processed, the data will be deleted. For minors, the aforementioned consent must be given by the legal guardian(s).
Exclusion of Participants
Medicom reserves the right to exclude participants from the contest who have provided false information, violated the terms of participation, manipulated or had manipulations carried out, do not fully own the rights to the uploaded photo, or whose photos violate netiquette. In particular, minors will be excluded if they lack the necessary consent and approval of their legal guardian(s) to participate in the contest. Participation in the action through participation or contest registration services is also excluded.
Applicable Law
Exclusively the law of the Federal Republic of Germany applies. The right of appeal is excluded.

We are willing to participate in an out-of-court conciliation procedure before a consumer arbitration board.
